Terms & conditions of sale

The terms we sell on. Written in plain English on purpose — if anything here isn’t clear, ring us before you order rather than after.

1. Who we are

Hammer Tech (NI) Ltd, a company registered in Northern Ireland, company number NI067157, VAT registration number XI 821 1070 84. Registered office: 6 Doagh Road, Ballyclare, BT39 9BG. Trading address and workshop: Unit 5, Dennison Industrial Estate, Ballyclare, Co. Antrim, BT39 9EB.

2. These terms

These terms apply to everything we sell unless we have signed a separate written agreement with you that says otherwise. Placing an order means you accept them.

Most of our customers buy in the course of a business. If you are buying as a consumer — that is, wholly for your own private use — you have additional rights under consumer law which nothing in these terms takes away. Where a term below applies only to business customers, it says so.

3. Prices

  • We do not publish prices on this website. Every price is quoted to you individually, in pounds sterling or euro as agreed, and is exclusive of VAT unless the quote says otherwise.
  • Quoted prices exclude delivery. Delivery is quoted separately — see delivery & returns.
  • A quote can change if our costs or exchange rates move, but a price is fixed once we have accepted your order.
  • If an obvious error appears in a quote — a decimal in the wrong place, a machine priced at a fraction of its cost — we are not obliged to sell at that price. We will tell you promptly and either honour the correct price with your agreement or refund you in full.
  • Where you are quoted in euro, the euro price at the time we accept your order is the price you pay.

4. Orders

An order placed through this website is an offer to buy, not a completed contract. The contract comes into existence when we confirm the order or dispatch the goods, whichever happens first.

We may decline an order — for example if the item has just sold, if we believe the attachment is wrong for your carrier, or if we cannot verify the delivery address. If we decline, you are not charged, or you are refunded in full.

5. Payment

  • If we send you a card payment link, the payment is handled by Stripe. Your card details are entered on Stripe’s own secure pages. We never see, handle or store your card number.
  • Goods remain our property until we have received payment in full. Risk in the goods passes to you on delivery or collection.
  • Credit or account terms are available only by prior written arrangement. Where we have agreed account terms, invoices are due on the terms stated on the invoice.
  • Business customers: we may charge statutory interest on overdue amounts and recover reasonable costs of collection.

6. Getting the right attachment

This matters more than anything else on this page, so read it.

A hydraulic attachment has to match the carrier it goes on — operating weight, oil flow, working pressure and back pressure. Fit a breaker to the wrong machine and you will damage the breaker, the machine, or both, and no warranty covers that.

We will advise you, gladly and at no charge. Tell us the carrier’s make, model and operating weight and we will tell you which attachment suits it — including when a cheaper or smaller unit is the better buy. That advice is given in good faith on the information you give us.

Because we cannot inspect your machine or verify its hydraulic settings ourselves, the final responsibility for confirming that an attachment is suitable for your carrier and your application rests with you. If you are not certain, ask us before you order, not after.

7. Warranty

New attachments we supply carry a 12 month warranty from the date of delivery. Refurbished attachments carry a 1 year warranty. Warranty covers defects in materials and manufacture.

What warranty does not cover

  • Wear parts. Chisels and moil points, tool bushes, seals, o-rings, wipers, diaphragms, cushion rubbers and body bolts are consumable items. They wear out in normal use and are not warranty items.
  • Operation outside specification. Running the attachment at oil flows or pressures outside the manufacturer’s figures, or on a carrier outside the stated weight range.
  • Misuse. This includes using a breaker as a lever or a prying tool, blank firing, driving the chisel into boulders rather than working the top of the material, continuous operation at full angle, and underwater use without the correct kit.
  • Missed greasing or servicing. Attachments need greasing at the intervals the manufacturer states. Damage caused by running them dry is not a manufacturing defect.
  • Accident damage, transport damage after delivery, or repairs and modifications carried out by anyone else without our agreement.

How to make a claim

Ring us. Do not strip the attachment down and do not have work carried out elsewhere before speaking to us, because that usually makes it impossible to establish what actually happened.

We will normally want to inspect the attachment, either at our workshop or on site. Where a warranty claim is upheld we will repair or replace the defective part, or replace the attachment, at our option. Where inspection shows the fault was caused by something in the list above, we will tell you plainly what we found and quote you for the repair.

8. Liability

The following limits apply to business customers. If you are a consumer, your statutory rights are unaffected.

  • We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
  • Subject to that, our total liability in connection with any order is limited to the price you paid for the goods or services in question.
  • We are not liable for loss of profit, loss of contract, machine downtime, hire of replacement equipment, or other indirect or consequential loss.

9. General

We are not liable for delays caused by events outside our reasonable control — supplier failure, shipping delays, extreme weather, industrial action and the like. We will tell you what is happening and, if the delay is substantial, you may cancel and be refunded for anything undelivered.

These terms are governed by the law of Northern Ireland, and the courts of Northern Ireland have jurisdiction.
